        INTRODUCED BY KAISER, READSHAW, GEORGE, GODSHALL, CALTAGIRONE,
           HALUSKA, CAWLEY, WOJNAROSKI, SOLOBAY, HORSEY, DALEY,
           KIRKLAND, PISTELLA, BELFANTI, HARHAI, FRANKEL, LAUGHLIN,
           YOUNGBLOOD, COSTA, DIVEN, STEELMAN, PRESTON AND LaGROTTA,
           APRIL 25, 2001

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JUNE 12, 2001

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to grant and convey the David L.
     3     Lawrence Convention Center and other interests situate in the
     4     City of Pittsburgh, Allegheny County, to the Sports and
     5     Exhibition Authority.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Authorization to convey David L. Lawrence Convention
     9                 Center and other interests.
    10     (a)  Authorization.--The Department of General Services, with
    11  the approval of the Governor, is authorized and directed on
    12  behalf of the Commonwealth:
    13         (1)  To grant and convey to the authority SPORTS AND       <--
    14     EXHIBITION AUTHORITY created under Article XXV-A of the act
    15     of July 28, 1953 (P.L.723, No.230), known as the Second Class
    16     County Code, for a consideration of $1, the tract of land,
    17     with the structures, facilities, buildings, fixtures and


     1     improvements erected thereon, situate in the City of
     2     Pittsburgh, Allegheny County, Pennsylvania, and known as the
     3     David L. Lawrence Convention Center, as described by a deed
     4     dated July 1, 1975, and recorded in the Allegheny COUNTY       <--
     5     Recorder of Deeds Office, July 25, 1975, in deed book volume
     6     5509, page 13.
     7         (2)  To grant and convey, by quit claim deed, to the
     8     authority created under Article XXV-A of the act of July 28,   <--
     9     1953 (P.L.723, No.230), known as the Second Class County
    10     SPORTS AND EXHIBITION AUTHORITY CREATED UNDER ARTICLE XXV-A    <--
    11     OF THE SECOND CLASS COUNTY Code, for a consideration of $1,
    12     any property or interests near or adjacent to the convention
    13     center within the boundary of Garrison Place, the low tide
    14     line of the Allegheny River, the eastern boundary line of the
    15     David L. Lawrence Convention Center, as described by a deed
    16     dated July 1, 1975, and recorded in the Allegheny COUNTY       <--
    17     Recorder of Deeds Office, July 25, 1975, in deed book volume
    18     5509, page 13 and Penn Avenue that is ARE acquired by the      <--
    19     Commonwealth prior to the date of the conveyance and any       <--
    20     options to acquire such adjacent property held by the
    21     Commonwealth on the date of the conveyance. CONVEYANCE.        <--
    22     (b)  Easements.--The conveyances shall be made under and
    23  subject to all lawful and enforceable easements, servitudes and
    24  rights of others, including, but not confined to, streets,
    25  roadways and rights of any telephone, telegraph, water,
    26  electric, sewer, gas or pipeline companies, as well as under and
    27  subject to any lawful and enforceable interest, estates or
    28  tenancies vested in third persons appearing of record, for any
    29  portion of the land or improvements erected thereon.
    30     (c)  Labor contracts.--The authority created under Article     <--

     1  XXV-A of the Second Class County Code SPORTS AND EXHIBITION       <--
     2  AUTHORITY shall be bound by the terms of any labor contracts
     3  relating to the convention center that are in effect at the time
     4  of its conveyance to the authority. SPORTS AND EXHIBITION         <--
     5  AUTHORITY. THE AUTHORITY MAY NOT LIMIT BIDS OR CONTRACTS ENTERED
     6  INTO AFTER THE EFFECTIVE DATE OF THIS ACT THAT RELATE TO THE
     7  CONVENTION CENTER TO CONTRACTORS WHO ARE UNION MEMBERS OR WHOSE
     8  WORKERS ARE UNION MEMBERS OR TO CONTRACTORS WHO AGREE OR WHOSE
     9  WORKERS AGREE TO JOIN THE APPROPRIATE UNION AFTER BEGINNING
    10  EMPLOYMENT.
    11     (D)  REPORT.--
    12         (1)  THE AUTHORITY SHALL, NO LATER THAN THE START OF EACH
    13     FISCAL YEAR, PREPARE A COMPREHENSIVE ANNUAL REPORT OF ITS
    14     ACTIVITIES AND OPERATIONS FOR THE PREVIOUS YEAR RELATING TO
    15     CONTRACTUAL ARRANGEMENTS BETWEEN THE AUTHORITY AND MINORITY-
    16     OWNED AND OPERATED BUSINESSES AND WOMEN-OWNED AND OPERATED
    17     BUSINESSES. THE REPORT SHALL INCLUDE:
    18             (I)  THE NAMES AND ADDRESSES OF MINORITY-OWNED AND
    19         OPERATED BUSINESSES AND WOMEN-OWNED AND OPERATED
    20         BUSINESSES WITH WHICH THE AUTHORITY HAS ENTERED INTO
    21         CONTRACTS AND THE NATURE OF THOSE CONTRACTS.
    22             (II)  A DESCRIPTION OF ANY PROGRAM OR PROCEDURES USED
    23         BY THE AUTHORITY TO IDENTIFY MINORITY-OWNED AND OPERATED
    24         BUSINESSES AND WOMEN-OWNED AND OPERATED BUSINESSES WHICH
    25         COULD MEET THE CONTRACTUAL NEEDS OF THE AUTHORITY. THE
    26         AUTHORITY SHALL DELINEATE EFFORTS USED TO IDENTIFY
    27         MINORITY-OWNED AND OPERATED BUSINESSES AND WOMEN-OWNED
    28         AND OPERATED BUSINESSES THAT ARE LOCATED WITHIN AND
    29         OUTSIDE THE AUTHORITY'S LOCALITY.
    30             (III)  AN EVALUATION OF THE AUTHORITY'S EFFORTS TO

     1         INCLUDE MINORITY-OWNED AND OPERATED BUSINESSES AND WOMEN-
     2         OWNED AND OPERATED BUSINESSES IN ITS CONTRACTUAL
     3         ARRANGEMENTS.
     4         (2)  THE AUTHORITY SHALL FORWARD A COPY OF THE ANNUAL
     5     REPORT EACH YEAR TO THE GOVERNOR AND TO THE GENERAL ASSEMBLY.
     6     (d) (E)  Execution.--The deeds shall be approved as provided   <--
     7  by law and shall be executed by the Secretary of General
     8  Services in the name of the Commonwealth.
     9     (e) (F)  Costs and fees.--Costs and fees incidental to the     <--
    10  conveyances shall be borne by the grantee.
    11     (f) (G)  Hotel tax revenues not affected.--The conveyance of   <--
    12  the convention center under this section shall not affect the
    13  availability of the revenues from the hotel tax authorized in
    14  section 1970.2 of the Second Class County Code to fund the
    15  operational and maintenance expenditures of the convention
    16  center.
    17  Section 2.  Effective date.
    18     This act shall take effect immediately.
