                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to grant and convey the David L.
     3     Lawrence Convention Center and other interests situate in the
     4     City of Pittsburgh, Allegheny County, to the Sports and
     5     Exhibition Authority.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Authorization to convey David L. Lawrence Convention
     9                 Center and other interests.
    10     (a)  Authorization.--The Department of General Services, with
    11  the approval of the Governor, is authorized and directed on
    12  behalf of the Commonwealth:
    13         (1)  To grant and convey to the Sports and Exhibition
    14     Authority created under Article XXV-A of the act of July 28,
    15     1953 (P.L.723, No.230), known as the Second Class County
    16     Code, for a consideration of $1, the tract of land, with the
    17     structures, facilities, buildings, fixtures and improvements

     1     erected thereon, situate in the City of Pittsburgh, Allegheny
     2     County, Pennsylvania, and known as the David L. Lawrence
     3     Convention Center, as described by a deed dated July 1, 1975,
     4     and recorded in the Allegheny County Recorder of Deeds
     5     Office, July 25, 1975, in deed book volume 5509, page 13.
     6         (2)  To grant and convey, by quit claim deed, to the
     7     Sports and Exhibition Authority created under Article XXV-A
     8     of the Second Class County Code, for a consideration of $1,
     9     any property or interests near or adjacent to the convention
    10     center within the boundary of Garrison Place, the low tide
    11     line of the Allegheny River, the eastern boundary line of the
    12     David L. Lawrence Convention Center, as described by a deed
    13     dated July 1, 1975, and recorded in the Allegheny County
    14     Recorder of Deeds Office, July 25, 1975, in deed book volume
    15     5509, page 13 and Penn Avenue that are acquired by the
    16     Commonwealth prior to the date of the conveyance.
    17     (b)  Easements.--The conveyances shall be made under and
    18  subject to all lawful and enforceable easements, servitudes and
    19  rights of others, including, but not confined to, streets,
    20  roadways and rights of any telephone, telegraph, water,
    21  electric, sewer, gas or pipeline companies, as well as under and
    22  subject to any lawful and enforceable interest, estates or
    23  tenancies vested in third persons appearing of record, for any
    24  portion of the land or improvements erected thereon.
    25     (c)  Labor contracts.--The Sports and Exhibition Authority
    26  shall be bound by the terms of any labor contracts relating to
    27  the convention center that are in effect at the time of its
    28  conveyance to the Sports and Exhibition Authority. The authority  <--
    29  may not limit bids or contracts entered into after the effective
    30  date of this act that relate to the convention center to

     1  contractors who are union members or whose workers are union
     2  members or to contractors who agree or whose workers agree to
     3  join the appropriate union after beginning employment.
     4  AUTHORITY.                                                        <--
     5     (d)  Report.--
     6         (1)  The authority shall, no later than the start of each
     7     fiscal year, prepare a comprehensive annual report of its
     8     activities and operations for the previous year relating to
     9     contractual arrangements between the authority and minority-
    10     owned and operated businesses and women-owned and operated
    11     businesses. The report shall include:
    12             (i)  The names and addresses of minority-owned and
    13         operated businesses and women-owned and operated
    14         businesses with which the authority has entered into
    15         contracts and the nature of those contracts.
    16             (ii)  A description of any program or procedures used
    17         by the authority to identify minority-owned and operated
    18         businesses and women-owned and operated businesses which
    19         could meet the contractual needs of the authority. The
    20         authority shall delineate efforts used to identify
    21         minority-owned and operated businesses and women-owned
    22         and operated businesses that are located within and
    23         outside the authority's locality.
    24             (iii)  An evaluation of the authority's efforts to
    25         include minority-owned and operated businesses and women-
    26         owned and operated businesses in its contractual
    27         arrangements.
    28         (2)  The authority shall forward a copy of the annual
    29     report each year to the Governor and to the General Assembly.
    30     (e)  Execution.--The deeds shall be approved as provided by

     1  law and shall be executed by the Secretary of General Services
     2  in the name of the Commonwealth.
     3     (f)  Costs and fees.--Costs and fees incidental to the
     4  conveyances shall be borne by the grantee.
     5     (g)  Hotel tax revenues not affected.--The conveyance of the
     6  convention center under this section shall not affect the
     7  availability of the revenues from the hotel tax authorized in
     8  section 1970.2 of the Second Class County Code to fund the
     9  operational and maintenance expenditures of the convention
    10  center.
    11  Section 2.  Effective date.
    12     This act shall take effect immediately.
