AN ACT 1 Amending Title 66 (Public Utilities) of the Pennsylvania 2 Consolidated Statutes, defining "on bill financing"; and 3 providing for on bill financing program. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 102 of Title 66 of the Pennsylvania 7 Consolidated Statutes is amended by adding a definition to read: 8 § 102. Definitions. 9 Subject to additional definitions contained in subsequent 10 provisions of this part which are applicable to specific 11 provisions of this part, the following words and phrases when 12 used in this part shall have, unless the context clearly 13 indicates otherwise, the meanings given to them in this section: 14 * * * 15 "On bill financing." A low interest or no interest financing 16 agreement between a small business consumer, as defined in 17 section 2 of the act of December 21, 1988 (P.L.1871, No.181),
1 known as the Small Business Advocate Act, and an electric 2 utility for the purpose of purchasing or installing energy 3 efficient or renewable energy equipment at the small business, 4 under which the regularly scheduled payment of that small 5 business consumer to that electric utility is not reduced by the 6 amount of the reduction in cost attributable to the new 7 equipment and that amount is credited to the electric utility, 8 until the cost of the purchase or installation is repaid. 9 * * * 10 Section 2. Title 66 is amended by adding a section to read: 11 § 531. On bill financing program. 12 (a) General rule.--The commission shall, for each electric 13 generation supplier, establish an on bill financing program that 14 at a minimum: 15 (1) Enables small business consumers to finance all of 16 the upfront costs for the purchase and installation of a 17 cost-effective energy saving product or a renewable energy 18 system that is to be installed at the customer's location and 19 repay those costs over time at the difference between what 20 the customer would have paid for electricity and the actual 21 savings derived by the customer. 22 (2) Ensures that the reasonable costs of the electric 23 generation supplier are recovered. 24 (3) Ensures that all costs of the program are solely 25 borne by program participants and are not shifted to the 26 other customers or classes of customers of the electrical 27 corporations. 28 (b) Annual reports.--The commission shall issue an annual 29 report to the General Assembly regarding the program and any 30 legislative recommendations. 20070H1431B2464 - 2 -
