AN ACT 1 Authorizing the release of Project 70 restrictions imposed on 2 certain lands owned by the City of Jeannette, Westmoreland 3 County, in return for the imposition of Project 70 4 restrictions placed on certain lands purchased by the City of 5 Jeannette. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The lands described in section 2 are hereby 9 released from restrictions imposed under the act of June 22, 10 1964 (Sp.Sess., P.L.131, No.8), known as the Project 70 Land 11 Acquisition and Borrowing Act, in exchange for the imposition of 12 restrictions under the Project 70 Land Acquisition and Borrowing 13 Act on the lands described in section 3. 14 Section 2. The lands authorized to be released from 15 restrictions are more particularly described as follows: 16 Beginning at a point where the northerly line of College 17 Avenue intersects with the easterly line of Whiteman Street, 18 thence along the easterly line of Whiteman Street north 44 19 degrees 45 minutes east a distance of 455 feet to a point;
1 thence south 42 degrees 15 minutes east a distance of 66.5 feet 2 to a point; thence north 36 degrees 5 minutes east a distance of 3 178 feet, more or less, to a point; thence south 24 degrees 41 4 minutes east a distance of 315 feet, more of less, to a point; 5 thence south 42 degrees west a distance of 120 feet, more or 6 less, to a point; thence south 16 degrees 13 minutes east a 7 distance of 345 feet, more or less, to a point; thence north 72 8 degrees 42 minutes west a distance of 181.67 feet to a point; 9 thence south 17 degrees 18 minutes west a distance of 40 feet to 10 a point; thence north 72 degrees 42 minutes west a distance of 11 40 feet to a point; thence north 17 degrees 18 minutes east a 12 distance of 131 feet to a point on the northerly line of College 13 Avenue; thence along the northerly line of College Avenue north 14 72 degrees 42 minutes west a distance of 448 feet to a point on 15 the easterly line of Whiteman Street, the place of beginning. 16 Containing approximately 4.7 acres. 17 Section 3. The land to be subject to restrictions is more 18 particularly described as follows: 19 Beginning at a point at the southwesterly line of Harrison 20 Avenue and the easterly line of School Street, thence along the 21 southwesterly line of Harrison Avenue south 77 degrees 4 minutes 22 east 145 feet to a point; thence by same by a line curving to 23 the right, having a radius of 23 feet, an arc distance of 31.50 24 feet to a point in the westerly line of Sellers Avenue; thence 25 along the westerly line of Sellers Avenue south 10 degrees 40 26 minutes west 20.6 feet to a point; thence along same by a line 27 curving to the left, having a radius of 332.56 feet, an arc 28 distance of 97.27 feet to a point; thence leaving Sellers Avenue 29 south 67 degrees 48 minutes west 5.87 feet to a point; thence 30 again along Sellers Avenue south 24 degrees 25 minutes east 19970H1439B1696 - 2 -
1 126.20 feet to a point, corner of property of the Jeannette 2 School District; thence along line of lands of Jeannette School 3 District south 78 degrees 1 minute west 130.92 feet to a point; 4 thence along the same north 40 degrees 42 minutes west 38.78 5 feet to a point; thence along the northerly line of Morris 6 Avenue, an unopened street in the Westmoreland Home and Land Co. 7 Plan, north 77 degrees 4 minutes west 125.76 feet to a point, 8 corner of the northerly line of Morris Avenue and School Street, 9 north 12 degrees 56 minutes east 265 feet to the point at the 10 place of beginning. 11 Containing approximately 1.3 acres. 12 Section 4. The restrictions to be included in the deed to 13 the land described in section 3 shall read as follows: 14 This indenture is given to provide recreation, conservation 15 and historical purposes as defined in the act of June 22, 1964 16 (Sp.Sess., P.L.131, No.8), known as the Project 70 Land 17 Acquisition and Borrowing Act. 18 Section 5. The sum of $20,000 or proceeds from the sale of 19 the land described in section 2, whichever is greater, shall be 20 deposited into a special account established by the City of 21 Jeannette and used exclusively by the City of Jeannette for 22 recreational improvements on the land described in section 3. 23 Section 6.
