                                     AN ACT

     1  Amending the act of January 17, 1968 (P.L.11, No.5), entitled
     2     "An act establishing a fixed minimum wage and overtime rates
     3     for employes, with certain exceptions; providing for minimum
     4     rates for learners and apprentices; creating a Minimum Wage
     5     Advisory Board and defining its powers and duties; conferring
     6     powers and imposing duties upon the Department of Labor and
     7     Industry; imposing duties on employers; and providing
     8     penalties," further providing for agricultural exemptions.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 3 of the act of January 17, 1968 (P.L.11,
    12  No.5), known as The Minimum Wage Act of 1968, is amended by
    13  adding definitions to read:
    14     Section 3.  Definitions.--As used in this act:
    15     * * *
    16     (j)  "Farm" means any real property, including structures,
    17  facilities and fixtures used in the production of a farm
    18  product.
    19     (k)  "Farm product" means any vegetable; fruit, nut;


     1  agricultural, horticultural, floricultural or silvicultural
     2  product; fur-bearing animal; livestock or livestock product;
     3  poultry or poultry product; aquacultural product; wool; hides;
     4  dairy product; honey and syrup.
     5     (l)  "Farmer" means a person who is in the business of
     6  operating a farm as a commercial enterprise.
     7     (m)  "Labor on a farm" means any activity performed by a
     8  person on a farm that is performed pursuant to, in furtherance
     9  of or incidental to the planting, breeding, raising, growing,
    10  training, shearing, harvesting, herding, gathering, packaging,
    11  caging, crating or preparing for transport or marketing of any
    12  farm product, regardless of whether the person is employed by
    13  the farmer or another person.
    14     Section 2.  This act shall take effect in 60 days.
