1Amending the act of March 1, 1974 (P.L.90, No.24), entitled "An
2act relating to the labeling, distribution, storage,
3transportation, use, application and disposal of pesticides
4and devices; providing for registration and examination of
5such materials; the licensing of pesticide dealers and pest
6management consultants and imposing penalties," further
7providing for definitions; and providing for notification.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Section 4 of the act of March 1, 1974 (P.L.90,
11No.24), known as the Pennsylvania Pesticide Control Act of 1973,
12is amended by adding paragraphs to read:

13Section 4. Definitions.--As used in this act:

15(34.1) "Private park" means privately owned outdoor real
16estate which includes a recreational area for use by the public,
17including an area with restricted access.

19(36.1) "Public park" means publicly owned outdoor real

1estate which includes a recreational area for use by the public,
2including an area with restricted access.

3(36.2) "Recreational area" means an outdoor place of
4relaxation, play or exercise.

6Section 2. The act is amended by adding a section to read:

7Section 27.1. Notification.--For pesticide applications to a
8private park or to a public park, notice of the date of proposed
9pesticide application shall be provided by placing a sign at
10each entrance to the private park or public park. Notice shall
11be provided not less than 72 hours nor more than seven days
12prior to the pesticide application.

13Section 3. This act shall take effect in 60 days.
