                                     AN ACT

     1  Requiring containers for collecting glass, aluminum and plastic
     2     in public stadiums; requiring containers for collecting glass
     3     and aluminum in public rest areas under the jurisdiction of
     4     the Pennsylvania Turnpike Commission; and imposing a penalty.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7  Section 1.  Short title.
     8     This act shall be known and may be cited as the Recycling
     9  Container Availability Act.
    10  Section 2.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Commission."  The Pennsylvania Turnpike Commission.

     1     "Public stadium."  A structure open to the public, including,
     2  but not limited to, State and municipal stadiums, public
     3  convention centers or arenas, school and entertainment stadiums.
     4  Section 3.  Containers for glass, aluminum and plastic.
     5     In all public stadiums where a receptacle for trash is
     6  maintained for users of the public stadium, the owner or
     7  operator of the public stadium shall maintain in close proximity
     8  to the trash receptacle a container for collecting glass, a
     9  container for collecting aluminum and a container for collecting
    10  plastic. The owner or operator of the public stadium shall also
    11  establish, with the local county recycling coordinator, a method
    12  of transporting the collected recyclable materials to their
    13  respective markets in conjunction with existing local recycling
    14  programs.
    15  Section 4.  Containers for glass, aluminum and plastic.
    16     In all public rest areas under the jurisdiction of the
    17  commission where a receptacle for trash is maintained for users
    18  of the public rest area, the commission shall maintain in close
    19  proximity to the trash receptacle, a container for collecting
    20  glass, a container for collecting aluminum and a container for
    21  collecting plastic. The commission shall also establish, with
    22  the local county recycling coordinator, a method of transporting
    23  the collected recyclable material to their respective markets in
    24  conjunction with local existing recycling programs.
    25  Section 5.  Penalty.
    26     An owner or operator of a public stadium who fails to comply
    27  with section 3 commits a summary offense and shall, upon
    28  conviction, be sentenced to pay a fine of $25.
    29  Section 6.  Implementation.
    30     The provisions of this act shall be implemented within one

     1  year of the effective date of this act.
     2  Section 7.  Effective date.
     3     This act shall take effect in 60 days.
