                                     AN ACT

     1  Providing a residency requirement for constables and deputy
     2     constables.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Constable and deputy constable eligibility.
     6     (a)  Residency required.--
     7         (1)  Constables and deputy constables for any ward or
     8     municipality shall be duly registered electors of the ward or
     9     municipality from which they have been elected or, in the
    10     case of vacancy, for which they have been appointed.
    11         (2)  A candidate for the position of constable or deputy
    12     constable for any ward or municipality shall be a duly
    13     registered elector of the ward or municipality for which the
    14     candidate seeks to be elected or appointed.
    15         (3)  Constables and deputy constables shall continue to
    16     be duly registered electors of such ward or municipality
    17     during their term of service and shall reside continuously in

     1     such ward or municipality during their term of office.
     2     (b)  Application.--This section shall apply to all constables
     3  and deputy constables one year after the effective date of this
     4  act. No person or deputy constable shall be eligible for
     5  election or appointment as a constable or deputy constable on or
     6  after the effective date of this act unless such person is in
     7  compliance with subsection (a).
     8  Section 2.  Effective date.
     9     This act shall take effect immediately.
