                                     AN ACT

     1  Amending the act of November 10, 1999 (P.L.491, No.45), entitled
     2     "An act establishing a uniform construction code; imposing
     3     powers and duties on municipalities and the Department of
     4     Labor and Industry; providing for enforcement; imposing
     5     penalties; and making repeals," further providing for the
     6     powers of the Department of Labor and Industry relating to
     7     State-owned buildings; and establishing the Uniform
     8     Construction Fund.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 103 of the act of November 10, 1999
    12  (P.L.491, No.45), known as the Pennsylvania Construction Code
    13  Act, is amended by adding a definition to read:
    14  Section 103.  Definitions.
    15     The following words and phrases when used in this act shall
    16  have the meanings given to them in this section unless the
    17  context clearly indicates otherwise:

    19     "Fund."  The Uniform Construction Fund established under


     1  section 704.

     3     Section 2.  Section 105(b) of the act is amended by adding a
     4  paragraph to read:
     5  Section 105.  Department of Labor and Industry.

     7     (b)  State-owned buildings.--
     8         * * *
     9         (5)  The department may enter into contracts with
    10     municipalities, councils of governments, construction code
    11     officials and third-party agencies for the administration and
    12     enforcement of this act for State-owned buildings including a
    13     State-affiliated entity or State-related institution as
    14     defined in 62 Pa.C.S. § 103 (relating to definitions).

    16     Section 3.  The act is amended by adding a section to read:
    17  Section 704.  Uniform Construction Fund.
    18     (a)  Establishment.--There is established in the State
    19  Treasury a nonlapsing restricted receipt account to be known as
    20  the Uniform Construction Fund for the deposit of all fees levied
    21  and collected by the department as authorized under this act and
    22  the regulations promulgated under it.
    23     (b)  Distribution of moneys.--All money deposited in this
    24  account and any investment income that money accrues are
    25  appropriated annually to the Department of Labor and Industry.
    26     (c)  Purpose.--The department shall utilize the fund to
    27  administer this act.
    28     Section 4.  This act shall take effect in 60 days.
