AN ACT 1 Making it a crime to take a deadly weapon onto certain 2 properties and providing a penalty. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. It shall be unlawful for any person, including a 6 student, to take a deadly weapon into a school facility or onto 7 any property adjacent to a school facility. 8 Section 2. The term "deadly weapon" as used herein means any 9 firearm, whether loaded or unloaded, or any device designed as a 10 weapon and capable of producing death or serious bodily injury, 11 or any other device or instrumentality which, in the manner in 12 which it is used or intended to be used, is calculated or likely 13 to produce death or serious bodily injury which has no 14 connection with the activities conducted by the school. 15 Section 3. This act shall not apply to law enforcement 16 personnel, a person licensed to carry a deadly weapon, students 17 engaging in a school-related activity involving the use of a
1 deadly weapon, or those participating in sports activities 2 conducted by schools involving the use of deadly weapons. 3 Section 4. A person who violates the provisions of this act 4 is guilty of a misdemeanor in the third degree and shall, upon 5 conviction thereof, be sentenced to imprisonment for not more 6 than one year, or to pay a fine not exceeding $500, or a 7 combination thereof. 8 Section 5.
