                                     AN ACT

     1  Amending the act of July 10, 1957 (P.L.685, No.362), entitled
     2     "An act regulating the use of explosives in certain blasting
     3     operations; requiring examination and licensing of certain
     4     explosives' detonators and prescribing the fee thereof; and
     5     conferring powers and imposing duties on the Department of
     6     Labor and Industry," further providing for blasting
     7     operations and for penalties.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 3 of the act of July 10, 1957 (P.L.685,
    11  No.362), referred to as the Explosives Use Regulation Law, is
    12  amended by adding a subsection to read:
    13     Section 3.  Blasting Operations Conducted in Accordance With
    14  Regulations.--* * *
    15     (a.1)  In all blasting operations, the blaster or person in
    16  charge of the blasting operations shall provide notice, no less
    17  than twenty-four hours prior to commencement of the blasting
    18  operations, to the property owner or owners of any dwelling
    19  house, public building, school, church, commercial or
    20  institutional building located within eight hundred feet of the

     1  immediate location that blasting operations are contemplated.
     2  The notice shall include, at a minimum, the name, address and
     3  telephone number of the blaster or person in charge, the date
     4  and time scheduled for each blasting operation and the distance,
     5  actual or approximate between the property of the owner so
     6  notified and the immediate location.

     8     Section 2.  Section 5 of the act is amended to read:
     9     Section 5.  Penalties.--Any person violating any of the
    10  provisions of this act, or any of the rules or regulations [of
    11  the Department of Labor and Industry made pursuant thereto,
    12  shall, upon conviction in a summary proceeding, be sentenced to
    13  pay a fine of not less than ten dollars ($10) nor more than one
    14  hundred dollars ($100), and upon failure to pay such fine and
    15  costs, shall undergo imprisonment for not more than thirty
    16  days.] promulgated under this act, commits a misdemeanor of the
    17  third degree.
    18     Section 3.  This act shall take effect in 60 days.
