        INTRODUCED BY COLEMAN, ARGALL, BARD, BENNINGHOFF, CALTAGIRONE,
           CAPPELLI, CREIGHTON, FREEMAN, HERSHEY, KELLER, MARSICO,
           McILHATTAN, R. MILLER, PHILLIPS, PIPPY, SATHER, SEMMEL,
           B. SMITH, TIGUE, WOJNAROSKI, YOUNGBLOOD AND STEELMAN,
           MAY 7, 2001

        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, MARCH 25, 2002

                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," further
     4     providing for the composition of the shade tree commission.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2722 of the act of February 1, 1966 (1965
     8  P.L.1656, No.581), known as The Borough Code, is amended to
     9  read:
    10     Section 2722.  Composition of Commission.--(a)  The [THE] (A)  <--
    11  EXCEPT AS PROVIDED IN SUBSECTION (B), THE commission shall be
    12  composed of three or five residents of the borough, as            <--
    13  determined by council, who shall be appointed by the council,
    14  and shall serve without compensation.
    15     (B)  THE COUNCIL, BY ORDINANCE, MAY PROVIDE THAT THE           <--
    16  COMMISSION BE COMPOSED OF FIVE MEMBERS WHO SHALL BE RESIDENTS OF
    17  THE BOROUGH, SHALL BE APPOINTED BY THE COUNCIL AND SHALL SERVE

     1  WITHOUT COMPENSATION.
     2     (b) (C)  Whenever a shade tree commission of three members is  <--
     3  established by any borough, the council shall appoint one member
     4  for a term of three years, one for a term of four years, and one
     5  for a term of five years. On the expiration of the term of any
     6  commissioner, a successor shall be appointed by the council to
     7  serve for a term of five years.
     8     (c) (D)  Whenever a shade tree commission of five members is   <--
     9  established by any borough, the council shall appoint members to
    10  staggered terms so that one term expires every year. On the
    11  expiration of the term of any commissioner, a successor shall be
    12  appointed by the council to serve for a term of five years.
    13     (d) (E)  Vacancies in the office of commissioner shall be      <--
    14  filled by the council for the unexpired term.
    15     Section 2.  This act shall take effect in 60 days.
