AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, further providing for 3 compensation and travel allowance for jurors. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 4561 of Title 42 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 4561. Compensation of and travel allowance for jurors. 9 (a) Compensation.--A person summoned to serve as a juror 10 shall receive compensation at the rate of [$9 a day for the 11 first three days in any calendar year he shall be required to 12 report for service and $25 a day] eight times the hourly minimum 13 wage set forth in section 6(a)(1) of the Fair Labor Standards 14 Act of 1938 (52 Stat. 1060, 29 U.S.C. § 206(a)(1)) for each day 15 [thereafter in such calendar year] that [such] the person is
1 required to report for service. In addition, persons so summoned 2 shall be paid a travel allowance to and from their residences at 3 the business standard mileage rate [of 17c/ per mile circular] 4 established by the Internal Revenue Service for deductible 5 business mileage expenses except that no travel allowance shall 6 be paid in the first judicial district. 7 (b) State reimbursement.--The Commonwealth shall reimburse 8 each county [80%] 50% of the amount expended by the county for 9 such compensation and travel allowance [beyond the first three 10 days of service] under subsection (a) if the juror is 11 participating in a trial or in grand jury proceedings. 12 Application for reimbursement shall be made by the county to the 13 State Treasurer through the Administrative Office pursuant to 14 procedures prescribed by said office. As used in this section, 15 trial participation shall include voir dire examination only if 16 such examination shall have commenced prior to the juror's 17 fourth day of service. 18 Section 2. The amendment of 42 Pa.C.S. § 4561 shall apply to 19 jurors summoned on or after the effective date of this act. 20 Section 3. This act shall take effect in 60 days. C14L42VDL/20010H1537B1864 - 2 -
