                                     AN ACT

     1  Providing for printing of reports mandated by statute; and
     2     imposing penalties.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Report
     7  Printing Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Mandated report."  A report which is required by statute to
    13  be made to the Governor; to the General Assembly, including
    14  committees; or to an administrative agency.
    15     "Reporting entity."  A person who is required to make a
    16  mandated report and who receives State funds in connection with

     1  the subject of the report. The term includes administrative
     2  agencies and political subdivisions.
     3  Section 3.  Printing mandated reports.
     4     (a)  Requirements.--
     5         (1)  A reporting entity shall print a mandated report in
     6     upright type.
     7         (2)  A reporting entity shall print a mandated report
     8     with legibility comparable to that of Century type.
     9         (3)  A reporting entity shall print a mandated report on
    10     paper that is between 33-pound stock and 50-pound stock for
    11     text and that is between 33-pound stock and 65-pound stock
    12     for title pages.
    13     (b)  Prohibitions.--
    14         (1)  A reporting entity may not print a mandated report
    15     in a format utilizing more than three colors.
    16         (2)  In a mandated report, a reporting entity may not
    17     print headings in larger than 12-point modern type, and a
    18     reporting entity may not print text in larger than 10-point
    19     modern type. This paragraph does not apply to graphs or
    20     charts.
    21         (3)  A reporting entity may not print a mandated report
    22     utilizing paper that is less than 33-pound stock. A reporting
    23     entity may not print a mandated report utilizing paper for
    24     text that is more than 50-pound stock or utilizing paper for
    25     title pages that is more than 65-pound stock.
    26         (4)  A reporting entity may not use a photograph in a
    27     mandated report unless the photograph is necessary to clarify
    28     the report. A reporting entity may not use a color photograph
    29     in a mandated report.
    30  Section 4.  Penalties.

     1     A reporting entity which violates section 3(b) shall be
     2  liable to the Commonwealth in an amount equal to three times the
     3  cost of publication, in addition to court costs and attorney
     4  fees.
     5  Section 5.  Enforcement.
     6     (a)  Government.--The Attorney General shall bring actions
     7  under section 4.
     8     (b)  Private actions.--If the Attorney General does not bring
     9  an action under section 4, a private citizen may bring the
    10  action.
    11  Section 6.  Effective date.
    12     This act shall take effect in 60 days.
