                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall  be determined," further providing for
    21     submission of budget to General Assembly.

    22     The General Assembly of the Commonwealth of Pennsylvania
    23  hereby enacts as follows:
    24     Section 1.  Section 613 of the act of April 9, 1929 (P.L.177,
    25  No.175), known as The Administrative Code of 1929, amended or
    26  added September 17, 1978 (P.L.775, No.149), July 1, 1981
    27  (P.L.143, No.48) and August 14, 1991 (P.L.331, No.35), is

     1  amended to read:
     2     Section 613.  Submission of Budget to General Assembly.--As
     3  soon as possible after the organization of the General Assembly,
     4  but not later than the first full week in February of each year,
     5  except in the case where a Governor has been elected for his
     6  first term of office and then no later than the first full week
     7  in March, the Governor shall submit to the General Assembly
     8  copies of original agency budget requests and all subsequent
     9  revised agency budget requests and a State budget and program
    10  and financial plan embracing:
    11     (1)  A balanced operating budget for the ensuing fiscal year
    12  setting forth in detail:
    13     (i)  The amounts recommended by him to be appropriated to the
    14  General Assembly, the Judicial Department, the Governor, and the
    15  several administrative departments, boards, and commissions of
    16  the State Government, and to institutions within the State, and
    17  for all public purposes, classified by department or agency and
    18  by program.
    19     (ii)  The estimated revenues or receipts from any and all
    20  sources, and an estimated amount to be raised by taxation or
    21  otherwise, including proposals for new revenues and receipts.
    22  Any proposed increase in the rate of a tax, fee, revenue receipt
    23  or item shall not exceed the average of the percentage increase
    24  in the Statewide average weekly wage and the employment cost
    25  index. The term "employment cost index" shall mean the most
    26  recent official figures, for the previous twelve-month period
    27  beginning July 1 and ending June 30 for the Employment Cost
    28  Index Series for Elementary and Secondary Schools, reported by
    29  the Bureau of Labor Statistics of the Federal Department of
    30  Labor.

     1     (2)  A capital budget for the ensuing fiscal year setting
     2  forth capital projects to be financed from the proceeds of
     3  obligations of the Commonwealth or of its agencies or
     4  authorities or from operating funds.
     5     (3)  A program and financial plan for not less than the prior
     6  fiscal year, the current fiscal year, this budget year and the
     7  four succeeding fiscal years, which plan shall include for each
     8  such fiscal year:
     9     (i)  Actual or estimated operating expenditures classified by
    10  department or agency and by program, in reasonable detail, and
    11  actual or estimated revenue by major categories from existing
    12  and additional sources.
    13     (ii)  Clearly stated purposes of each program in terms of
    14  desired accomplishments.
    15     (iii)  Measures used to determine to what extent such program
    16  has achieved its stated purposes.
    17     (iv)  Actual or estimated levels of accomplishment for each
    18  program and actual or estimated levels of program activities and
    19  their associated costs.
    20     (v)  Clearly stated purposes for each recommended new or
    21  revised program, measures to be used to determine whether each
    22  new or revised program has achieved its purpose, estimated
    23  levels of additional or new accomplishment of each new or
    24  revised program, estimated levels of additional activities for
    25  each such program, and their associated costs.
    26     (vi)  When the Secretary of the Budget identifies a new or
    27  expanded program by criteria used in the budget instructions,
    28  the new or expanded program shall be displayed and justified as
    29  a separate item in the Governor's budget request. A new program
    30  shall not be considered to be enacted by the General Assembly in

     1  its first year unless it is specifically referred to or
     2  displayed as a line item in an appropriation bill.
     3     (4)  The budget shall list as a single, separate line item
     4  for each administrative department, board, and commission the
     5  amount which the Governor recommends to be appropriated for the
     6  ensuing fiscal year for public relations. For the purposes of
     7  this clause, "public relations" shall include the preparation,
     8  presentation and distribution of advertising, publications,
     9  radio tapes, television films and tapes, and media releases. The
    10  separate line item shall include all compensation, including
    11  fringe benefits; all travel, meal, lodging, and similar
    12  expenses; the cost of purchasing new equipment and supplies; the
    13  cost of leasing offices and equipment; the cost of purchasing
    14  material, including newspapers, magazines, movies, films and
    15  tapes; the cost of using wire service equipment; and all other
    16  similar public relations expenditures.
    17     Section 2.  This act shall take effect in 60 days.
