1 | hereby enacts as follows: |
2 | CHAPTER 1 |
3 | PRELIMINARY PROVISIONS |
4 | Section 101. Short title. |
5 | This act shall be known and may be cited as the Drop-out Data |
6 | Collection Act. |
7 | Section 102. Findings. |
8 | The General Assembly finds and declares as follows: |
9 | (1) Significant discrepancies in school district |
10 | reporting, drop-out statistics and graduation rate formulas |
11 | exist nationwide. |
12 | (2) The United States Secretary of Education recently |
13 | announced that the United States Department of Education will |
14 | require all states to use a Federal formula for the |
15 | calculation of drop-out and graduation rates. |
16 | (3) The Pennsylvania Department of Education's |
17 | statistics between the 1995-1996 and 2005-2006 school years |
18 | show that drop-out rates in this Commonwealth may have |
19 | decreased Statewide, but serious questions exist regarding |
20 | the uniformity in reporting, and therefore, the reliability |
21 | of that data. |
22 | Section 103. Definitions. |
23 | The following words and phrases when used in this act shall |
24 | have the meanings given to them in this section unless the |
25 | context clearly indicates otherwise: |
26 | "Charter school." The term shall have the same meaning as in |
27 | section 1703-A of the act of March 10, 1949 (P.L.30, No.14), |
28 | known as the Public School Code of 1949. |
29 | "Cyber charter school." The term shall have the same meaning |
30 | as in section 1703-A of act of March 10, 1949 (P.L.30, No.14), |

2 | "Department." The Department of Education of the |
3 | Commonwealth. |
4 | "Graduation gap." The percentage of students who entered the | <-- |
5 | ninth grade and did not graduate from the same high school in |
6 | the same school district four years later. |
7 | "School district." The term shall have the same meaning as |
8 | in section 102 of the act of March 10, 1949 (P.L.30, No.14), |
9 | known as the Public School Code of 1949. |
10 | "School entity." The term shall have the same meaning as in |
11 | section 1101-A of the act of March 10, 1949 (P.L.30, No.14), |
12 | known as the Public School Code of 1949. |

15 | Section 301. Powers and duties. |
16 | The department shall have the following powers and duties: |
17 | (1) To create by the 2010-2011 school year a Statewide |
18 | definition of "dropout," if none is provided by Federal |
19 | statute, regulation or guideline and, in accordance with any |
20 | Federal statute, regulation or guideline, report the |
21 | graduation rates, and drop-out rates and graduation-gap rates | <-- |
22 | in this Commonwealth. |
23 | (2) To implement and maintain a high-quality data |
24 | collection and reporting system that accurately accounts for |
25 | all students when calculating high school graduation and |
26 | drop-out rates in accordance with Federal regulations or |
27 | guidelines. The reporting system shall include the |
28 | calculation of graduation rates, and drop-out rates and the | <-- |
29 | graduation-gap rates in all school entities, charter schools |
30 | and cyber charter schools. |

1 | (3) To serve as a clearinghouse of information, policies | <-- |
2 | and strategies aimed at decreasing the number of dropouts. |
3 | (4) (3) To require school entities, charter schools and | <-- |
4 | cyber charter schools to report student drop-out information |
5 | to the department using the department's data collection |
6 | system. |
7 | Section 302. Data collection and reporting. |
8 | (a) Categories.--Pursuant to section 301, data collected by |
9 | the department on drop-out rates, and graduation rates and | <-- |
10 | graduation-gap rates shall be disaggregated in the following |
11 | categories: |
12 | (1) Limited English proficiency. |
13 | (2) Low income. |
14 | (3) Special education. |
15 | (4) Gifted education. |
16 | (5) Race/ethnicity. |
17 | (6) School entity. |
18 | (7) Charter school or cyber charter school. |
19 | (8) Gender. |
20 | (9) Geographic area. |
21 | (10) Other categories as determined by the department. |
22 | (b) Availability.--The department shall ensure that the data |
23 | collection and reporting system be accurate, uniform and |
24 | accessible to school entities, charter schools, cyber charter |
25 | schools and Commonwealth residents via the department's publicly |
26 | accessible Internet website. |

28 | ADMINISTRATION |
29 | Section 701. Reporting. |
30 | Beginning in the 2011-2012 school year and each school year |

1 | thereafter, the department shall annually prepare a report and |
2 | provide a copy of the report to the Education Committee of the |
3 | Senate and the Education Committee of the House of |
4 | Representatives and shall post a copy of the report on the |
5 | department's publicly accessible Internet website by September 1 |
6 | of each year, that contains, at a minimum, the following: |
7 | (1) All drop-out rates, and graduation rates and | <-- |
8 | graduation-gap rates reported by school entities, charter |
9 | schools and cyber charter schools, including school-level |
10 | data, disaggregated by the factors used to identify an at- |
11 | risk student and the following classifications: |
12 | (i) Limited English proficiency. |
13 | (ii) Low income. |
14 | (iii) Special education. |
15 | (iv) Gifted education. |
16 | (v) Race/ethnicity. |
17 | (vi) Gender. |
18 | (vii) School entity. |
19 | (viii) Geographic area. |
20 | (2) Highest grade level completed and age prior to |
21 | dropping out. |
22 | (b) Uniform reporting.--School entities, charter schools and |
23 | cyber charter schools shall use the definitions and formulas |
24 | established by the department if no Federal statute, regulation |
25 | or guideline exists when reporting the graduation rates, |
26 | drop-out rates and graduation-gap rates to the department. |
27 | School entities, charter schools and cyber charter schools shall |
28 | report these rates annually, as required by the department, on a |
29 | form to be developed and provided by the department. |
30 | (c) Guidelines and standards.--The department may develop |

1 | any guidelines or standards necessary to implement the |
2 | requirements of this act. |

4 | MISCELLANEOUS PROVISIONS |
5 | Section 1101. Effective date. |
6 | This act shall take effect July 1, 2009, or immediately, |
7 | whichever is later. |
