AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, ESTABLISHING CERTAIN FEES <-- 3 TO BE CHARGED BY THE CLERK OF QUARTER SESSIONS OF 4 PHILADELPHIA; authorizing clerks of courts of common pleas to 5 increase certain fees and to impose automation fees; AND <-- 6 MAKING A REPEAL. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Fee increases and automation fee. <-- 29 (a) Increasing existing fees.-- 30 (1) In counties of the second class A and the third 19990H1635B3631 - 3 -
1 through eighth class, including home rule counties of the 2 same class, the clerk of courts may increase any fee or 3 charge that exists as of the effective date of this section 4 with the approval of the president judge. The amount of any 5 increase may not be greater than the aggregate of the 6 consumer price index from the month in which the fee was last 7 established through June 1998. 8 (2) The amount of any fee or charge increased pursuant 9 to paragraph (1) may be increased every three years, provided 10 that the amount of the increase may not be greater than the 11 percentage of increase in the Consumer Price Index for Urban 12 Workers for the immediate three years preceding the last 13 increase in the fee or charge. 14 (b) Automation fee for clerk of courts office.--In addition 15 to any other fee authorized by law, an automation fee of not 16 more than $5 may be charged and collected by the clerk of courts 17 of counties of the second class A and the third through eighth 18 class, including home rule counties of the same class, for the 19 initiation of any action or legal proceeding. The automation fee 20 shall be deposited into a special clerk of courts automation 21 fund established in each county. Moneys in the special fund 22 shall be used solely for the purpose of automation and continued 23 automation update of the office of the clerk of courts. 24 SECTION 2. THE ACT OF OCTOBER 12, 1984 (P.L.964, NO.188), <-- 25 REFERRED TO AS THE PHILADELPHIA QUARTER SESSIONS CLERK FEE LAW, 26 IS REPEALED. 27 Section 2 3.
