HOUSE BILL

                                     AN ACT

     1  Providing for compliance with building codes in second class A
     2     cities; and imposing penalties.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Second Class
     7  A City Building Code Compliance Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Known to have."  Knowledge based on a disclosure made
    13  pursuant to the act of July 2, 1996 (P.L.500, No.84), known as
    14  the Real Estate Seller Disclosure Act, knowledge based on a
    15  disclosure made to the purchaser during the course of purchase
    16  of the property or knowledge based on a building code violation
    17  of record.


     1  Section 3.  Compliance requirement.
     2     (a)  General rule.--Any purchaser of any building or part of
     3  a building known to have substantial violations of second class
     4  A city codes relating to building, housing, property maintenance
     5  or fire is required to make a reasonable attempt to bring the
     6  building or that part of a building into compliance with those
     7  codes or demolish the building within one year of the date of
     8  purchase.
     9     (b)  Personal liability.--Failure to comply with the
    10  requirements of subsection (a) shall result in the purchaser
    11  being personally liable for the costs of repairs or demolition
    12  and a fine of $10,000.
    13     (c)  Enforcement.--Second class A cities are authorized to
    14  enforce the provisions of this section.
    15  Section 4.  Effective date.
    16     This act shall take effect in 60 days.
