AN ACT
1 Providing for the crime of municipal housing code avoidance in
2 cities of the second class A.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Municipal housing code avoidance.
6 (a) Offense defined.--A person commits the crime of
7 municipal housing code avoidance in cities of the second class A
8 upon that person's fourth or subsequent conviction of a
9 violation of the second class A city housing code ordinance for
10 the same property without any reasonable attempt to correct the
11 violation.
12 (b) Grading.--Municipal housing code avoidance shall
13 constitute a:
14 (1) Misdemeanor of the second degree when the offense is
15 a fourth conviction of a violation under a second class A
16 city's housing code relating to the same property.
17 (2) Misdemeanor of the first degree when the offense is
1 based on five or more convictions of violations under a
2 second class A city's housing code relating to the same
3 property.
4 (c) Definition.--As used in this act, the term "municipal
5 housing code" means a second class A city's building, housing or
6 property maintenance code or ordinance.
7 Section 2. Effective date.
8 This act shall take effect in 60 days.
