                                     AN ACT

     1  Requiring notification of condemnation proceedings by public
     2     utilities and pipeline companies.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Notification of condemnation.
     6     Except as otherwise provided in section 2, a public utility
     7  or pipeline company possessing the authority to condemn real
     8  property shall provide written notice of its intent to condemn
     9  any real property to the governing bodies of all municipalities
    10  in which the real property is located at least 120 days prior to
    11  initiating any action under the act of June 22, 1964 (Sp.Sess.,
    12  P.L.84, No.6), known as the Eminent Domain Code.
    13  Section 2.  Exception.
    14     A public utility or pipeline company is not required to
    15  provide the notice under section 1 when it acts in response to
    16  an emergency.
    17  Section 3.  Effective date.


     1     This act shall take effect in 60 days.
