HOUSE BILL

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     loss of property rights to Commonwealth.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6801(h) of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6801.  Loss of property rights to Commonwealth.
     9     * * *
    10     (h)  Authorization to utilize property.--The district
    11  attorney and the Attorney General shall utilize forfeited
    12  property or proceeds thereof for the [purpose of] following
    13  purposes:
    14         (1)  for enforcing the provisions of The Controlled
    15     Substance, Drug, Device and Cosmetic Act[.];
    16         (2)  [In appropriate cases, the district attorney and the
    17     Attorney General may designate proceeds from forfeited
    18     property to be utilized by community-based drug] for drug

     1     prevention and crime-fighting programs [and];
     2         (3)  for relocation and protection of witnesses in
     3     criminal cases[.]; and
     4         (4)  for use in juvenile crime prevention.

     6     Section 2.  This act shall take effect immediately.
