                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for persons not to
     3     sell or possess, use, manufacture, control, sell or transfer
     4     firearms; and imposing penalties.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 6105(c)(2) of Title 18 of the
     8  Pennsylvania Consolidated Statutes is amended and the section is
     9  amended by adding a subsection to read:
    10  § 6105.  Persons not to possess, use, manufacture, control, sell
    11             or transfer firearms.

    13     (c)  Other persons.--In addition to any person who has been
    14  convicted of any offense listed under subsection (b), the
    15  following persons shall be subject to the prohibition of
    16  subsection (a):

    18         (2)  A person who has been convicted of an offense under

     1     the act of April 14, 1972 (P.L.233, No.64), known as The
     2     Controlled Substance, Drug, Device and Cosmetic Act, or any
     3     equivalent Federal statute or the statute of any other state
     4     that may be punishable by a term of imprisonment exceeding
     5     two years.

     7     (k)  Penalty.--
     8         (1)  Except as provided in paragraph (2), a person who
     9     violates the provisions of subsection (a)(1) commits a
    10     misdemeanor of the first degree.
    11         (2)  A person who violates the provisions of subsection
    12     (a)(1) who has previously been convicted of an offense under
    13     section 2502, 2503, 2702, 2703, 2704, 2901, 3121, 3123, 3301,
    14     3502, 3701 or 3923 or for a felony offense under The
    15     Controlled Substance, Drug, Device and Cosmetic Act or any
    16     equivalent Federal statute or statute of any other state
    17     commits a felony of the second degree.
    18     Section 2.  This act shall take effect in 60 days.
