                                     AN ACT

     1  Amending the act of November 1, 1971 (P.L.495, No.113),
     2     entitled, as amended, "An act providing for the compensation
     3     of county officers in counties of the second through eighth
     4     classes, for compensation of district attorneys in cities and
     5     counties of the first class, for the disposition of fees, for
     6     filing of bonds in certain cases and for duties of certain
     7     officers," further providing for the power of county
     8     commissioners to fix salaries.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 10.1(e) of the act of November 1, 1971
    12  (P.L.495, No.113), entitled, as amended, "An act providing for
    13  the compensation of county officers in counties of the second
    14  through eighth classes, for compensation of district attorneys
    15  in cities and counties of the first class, for the disposition
    16  of fees, for filing of bonds in certain cases and for duties of
    17  certain officers," amended December 18, 1984 (P.L.1067, No.212)
    18  and repealed in part November 23, 1994 (P.L.640, No.98), is
    19  amended and the section is amended by adding a subsection to
    20  read:


     1     Section 10.1.  * * *
     2     (e)  [Any] Except as provided in subsection (f), any salary
     3  increase shall be on a percentage basis and applied equally to
     4  all county officials except that the county commissioners may
     5  provide a greater percentage salary increase to the lowest paid
     6  county official, other than the jury commissioners or county
     7  auditor, until his salary is equal to the other county officials
     8  except the jury commissioners, county auditors, district
     9  attorneys and county commissioners.
    10     (f)  The county commissioners shall fix the salary of jury
    11  commissioners based on duties performed and hours actually
    12  worked. The limitation contained in subsection (c) shall not
    13  apply to a salary fixed under this subsection.
    14     Section 2.  This act shall apply when permitted under section
    15  27 of Article III of the Constitution of Pennsylvania.
    16     Section 3.  This act shall take effect immediately.
