AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," providing for failure to exercise
6 parental responsibility; and prescribing a penalty.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 1310-A. Failure to Exercise Parental
13 Responsibility.--(a) A parent, guardian or other person having
14 control or charge of a student is guilty of failing to exercise
15 parental responsibility if that parent, guardian or other person
16 knowingly fails to remove the student from the buildings or
17 grounds of a school entity after being requested to do so by an
18 administrator or educator of the school entity.
19 (b) Failure to exercise parental responsibility constitutes
1 a summary offense and is punishable by a fine not to exceed
2 three hundred dollars ($300).
3 Section 2. This act shall take effect in 60 days.
