AN ACT 1 Amending the act of April 23, 2002 (P.L.298, No.39), entitled 2 "An act providing for a commercial downtown enhancement 3 program to be administered by the Department of Community and 4 Economic Development," providing for the definition of 5 "construction code official"; and further providing for the 6 Main Street Program. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 2 of the act of April 23, 2002 (P.L.298, 10 No.39), known as the Main Street Act, is amended by adding a 11 definition to read: 12 Section 2. Definitions. 13 The following words and phrases when used in this act shall 14 have the meanings given to them in this section unless the 15 context clearly indicates otherwise: 16 "Construction code official." An individual certified by the 17 Department of Labor and Industry in an appropriate category 18 under section 701(b) of the act of November 10, 1999 (P.L.491, 19 No.45), known as the Pennsylvania Construction Code Act, to
1 perform plan review of construction documents, inspect 2 construction documents, inspect construction or administer and 3 enforce codes and regulations. 4 * * * 5 Section 2. Section 3(b) of the act is amended to read: 6 Section 3. Program. 7 * * * 8 (b) Requirements.--The program shall at a minimum include 9 the following components: 10 (1) Basic grants, for up to five years, for 11 administrative costs associated with the hiring of a manager 12 and a construction code official. 13 (2) Commercial downtown reinvestment grants for 14 infrastructure and structural improvements, including 15 streets, streetlights, trees, housing, commercial facades and 16 sidewalks or other pedestrian-oriented features. 17 (3) Plans for marketing and promoting the established 18 commercial downtown within the Main Street area. 19 (4) Plans to leverage additional private and public 20 investment in the Main Street area. 21 (5) Plans to address social or economic concerns within 22 the Main Street area. 23 (6) Plans, to the greatest extent possible, to achieve 24 consistency with existing revitalization efforts. 25 (7) An assessment of the potential need for the 26 following components: 27 (i) The establishment of a neighborhood improvement 28 district as defined in the act of December 20, 2000 29 (P.L.949, No.130), known as the Neighborhood Improvement 30 District Act. 20070H1682B2216 - 2 -
