AN ACT 1 Amending the act of November 22, 1978 (P.L.1166, No.274), 2 entitled "An act establishing the Pennsylvania Commission on 3 Crime and Delinquency, providing for its powers and duties 4 establishing several advisory committees within the 5 commission and providing for their powers and duties," 6 further providing for powers and duties of the commission. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 3 of the act of November 22, 1978 10 (P.L.1166, No.274), referred to as the Pennsylvania Commission 11 on Crime and Delinquency Law, is amended by adding a paragraph 12 to read: 13 Section 3. Powers and duties of the commission. 14 The commission shall have the power and its duty shall be: 15 * * * 16 (17) To prepare and present to the Governor and to the 17 General Assembly an analysis of any bill introduced in the 18 General Assembly that would have an impact on prison or jail
1 systems as well as on State and local probation and parole 2 populations and programs. To accomplish this the commission 3 shall establish a committee to prepare such impact analyses, 4 whose membership shall include representatives of the 5 commission, the Department of Corrections, the Pennsylvania 6 Board of Probation and Parole, the Pennsylvania Sentencing 7 Commission, and any other agencies whose participation is 8 deemed necessary by the commission. 9 Section 2. The act is amended by adding a section to read: 10 Section 9.1. Impact analysis utilization by General Assembly. 11 (a) Bills on second consideration.--A bill introduced in the 12 General Assembly which shall have an impact on prison or jail 13 systems as well as on State and local probation and parole 14 populations and programs shall not be given second consideration 15 in its house of origin until the committee established under 16 section 3(17) presents its required analysis to the Governor and 17 to the General Assembly. 18 (b) Limitation.--If, within 25 days of a bill's first 19 consideration by its house of origin, the committee fails to 20 present its impact analysis as required under subsection (a), 21 the bill may be considered as if the impact analysis had been 22 presented. 23 Section 3.
