HOUSE BILL

                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, providing for the regulation of the
     3     placement of public telephones in cities of the second class.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 66 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2916.  Authority of cities of the second class.
     9     (a)  Public telephone ordinances.--A city of the second class
    10  shall have the power to enact and enforce a local ordinance
    11  regulating the placement and maintenance of public telephones on
    12  city sidewalks. This ordinance may require that applicants
    13  obtain a permit from the city for the placement of a public
    14  telephone and may contain provisions relating to fees, the
    15  renewal of permits and the suspension or revocation of permits.
    16     (b)  Conversion ordinances.--A city of the second class shall
    17  have the power to enact and enforce local ordinances regulating
    18  the conversion of public telephones to one-way outgoing service

     1  only. Conversions of public telephones to one-way outgoing
     2  service only shall not be subject to the requirements set forth
     3  in the commission's regulations relating to conversion of public
     4  telephones to one-way outgoing service. In all other respects, a
     5  city of the second class shall be subject to and shall not pass
     6  local ordinances inconsistent with the rules and regulations of
     7  the commission.
     8     (c)  Limitation on permit revenues.--Permit fees which are
     9  imposed shall be reasonable and related solely to the costs of
    10  administering the permit and regulatory program.
    11     Section 2.  This act shall take effect immediately.
