AN ACT 1 Amending Title 20 (Decedents, Estates and Fiduciaries) of the 2 Pennsylvania Consolidated Statutes, further providing for 3 advance health care directive declarations and for advance 4 health care directive emergency medical services; and making 5 an appropriation. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Sections 5404 and 5413 of Title 20 of the 9 Pennsylvania Consolidated Statutes are amended by adding 10 subsections to read: 11 § 5404. Declaration. 12 * * * 13 (b.1) Driver's license or identification card.--Beginning as 14 soon as practicable, but no later than January 1, 2000, the 15 Department of Transportation shall redesign the driver's license 16 and identification card application system to process requests 17 for an individual to indicate on the driver's license or
1 identification card that the individual has executed a 2 declaration. The following question shall be asked: 3 Do you wish to have notice of your advance directive for 4 health care printed on your driver's license or 5 identification card? 6 Only an affirmative response of an individual shall be noted on 7 the front of the driver's license or identification card and 8 shall clearly indicate that the individual has executed a 9 declaration. 10 * * * 11 § 5413. Emergency medical services. 12 * * * 13 (d) Accidents.--Police and emergency medical services 14 personnel shall take reasonable steps to insure that a victim's 15 driver's license or personal identification card under section 16 5404(b.1) (relating to declaration) accompanies the victim to 17 the health care facility where the victim is treated. 18 Section 2. The sum of $ , or as much thereof as may be 19 necessary, is hereby appropriated to the Department of 20 Transportation for the fiscal year July 1, 1998, to June 30, 21 1999, to implement the addition of 20 Pa.C.S. § 5404(b.1). 22 Section 3.
