| AN ACT |
| |
1 | Prohibiting depictions of members of the General Assembly in |
2 | certain public service announcements; and prescribing a |
3 | penalty. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Short title. |
7 | This act shall be known and may be cited as the Legislative |
8 | Public Service Announcement Prohibition Act. |
9 | Section 2. Definitions. |
10 | The following words and phrases when used in this act shall |
11 | have the meanings given to them in this section unless the |
12 | context clearly indicates otherwise: |
13 | "Commonwealth funds." Any moneys appropriated from the |
14 | General Fund or any special fund in the State Treasury that is |
15 | comprised of moneys collected by a tax imposed by the |
16 | Commonwealth. |
17 | "Public service announcement." An advertisement that |
18 | promotes programs, activities or services of Federal, State or |

1 | local governments or the programs, activities or services of |
2 | nonprofit organizations or any other advertisement regarded as |
3 | serving community interests. |
4 | Section 3. Prohibition. |
5 | No person may depict the name, voice or image of a member of |
6 | the General Assembly in a public service announcement for which |
7 | Commonwealth funds were expended, if the expenditure involves: |
8 | (1) the purchase or the reimbursement for the purchase |
9 | of any radio or television broadcast time for the public |
10 | service announcement; or |
11 | (2) production costs associated with the public service |
12 | announcement. |
13 | Section 4. Penalty. |
14 | A person who violates section 3 commits a misdemeanor of the |
15 | third degree. |
16 | Section 5. Restitution. |
17 | The court shall, in addition to any other sentence authorized |
18 | by law, sentence a person convicted of violating section 3 to |
19 | make restitution to the Commonwealth in an amount equal to the |
20 | Commonwealth funds expended in violation of section 3. |
21 | Section 6. Effective date. |
22 | This act shall take effect in 60 days. |
