           E. Z. TAYLOR, SCHULER, CORRIGAN, FAIRCHILD, FRANKEL, GRUCELA,
           HARHAI, HENNESSEY, SERAFINI, TIGUE, WALKO, WOJNAROSKI AND
           YOUNGBLOOD, JUNE 21, 1999

                                     AN ACT

     1  Amending the act of August 6, 1963 (P.L.521, No.277) entitled
     2     "An act providing that probation officers shall have the
     3     power of peace officers in the performance of their duties,"
     4     further providing for powers of probation officers.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1 of the act of August 6, 1963 (P.L.521,
     8  No.277), entitled "An act providing that probation officers
     9  shall have power of peace officers in the performance of their
    10  duties," amended December 4, 1992 (P.L.766, No.117), is amended
    11  to read:
    12     Section 1.  Probation officers heretofore or hereafter
    13  appointed by any court of record of this Commonwealth are hereby
    14  declared to be peace officers, and shall have police powers and
    15  authority throughout the Commonwealth to arrest with or without
    16  warrant, writ, rule or process, any person on probation,
    17  intermediate punishment or parole under the supervision of said
    18  court for failing to report as required by the terms of his

     1  probation, intermediate punishment or parole or for any other
     2  violation of his probation, intermediate punishment or parole.
     3     Probation officers are also empowered and authorized to
     4  utilize their said Statewide police powers to aid or assist any
     5  other law enforcement officer upon request or upon reasonable
     6  belief of the need for such aid or assistance, and to also aid,
     7  assist or protect any other person who may be in danger of
     8  bodily injury.
     9     Section 2.  This act shall take effect in 60 days.
