THE GENERAL ASSEMBLY OF PENNSYLVANIA


HOUSE BILL

                                     AN ACT

     1  Amending the act of August 9, 1955 (P.L.323, No.130), entitled,
     2     as amended, "An act relating to counties of the third,
     3     fourth, fifth, sixth, seventh and eighth classes; amending,
     4     revising, consolidating and changing the laws relating
     5     thereto; and providing for regional renaissance initiatives,"
     6     providing for a Philadelphia Metropolitan Stadium Site
     7     Referendum.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of August 9, 1955 (P.L.323, No.130),
    11  known as The County Code, is amended by adding an article to
    12  read:
    13                            ARTICLE XXXI
    14         PHILADELPHIA METROPOLITAN STADIUM SITE REFERENDUM
    15     Section 3101.  Short Title.--This article shall be known and
    16  may be cited as the "Philadelphia Metropolitan Stadium Site
    17  Referendum."
    18     Section 3102.  Definitions.--As used in this article,
    19     "Central county" shall mean a county of the first class.
    20     "Contiguous county" shall mean a county, other than a county

     1  of the first class, that:
     2     (1)  has a boundary that touches, even at a single point, a
     3  county of the first class; or
     4     (2)  is a county of the third class and shares common
     5  boundaries at more than a single point with two counties
     6  described in clause (1).
     7     Section 3103.  Authorization.--The County Board of Election
     8  of the central county and each contiguous county shall cause to
     9  be printed on the official ballot, at the primary or general
    10  election occurring at least thirty days next following the
    11  effective date of this act, a nonbinding referendum to determine
    12  the will of the electorate in the city of the first class and
    13  each contiguous county with respect to public funding of
    14  professional sports stadiums.
    15     Section 3104.  Form of Question.--The referendum question
    16  shall be in substantially the following form:
    17         Do you favor the location of a new baseball stadium in
    18         the City of Philadelphia at:
    19             (1)  Broad and Spring Garden Streets;
    20             (2)  30th Street;
    21             (3)  South Philadelphia Sports Complex; or
    22             (4)  Port Richmond?
    23     Section 3105.  Conduct of Election.--The referendum required
    24  under this article shall be advertised and conducted in
    25  accordance with the provisions of the act of June 3, 1937
    26  (P.L.1333, No.320), known as the "Pennsylvania Election Code."
    27     Section 2.  This act shall take effect in 60 days.
