AN ACT 1 Amending the act of May 2, 1945 (P.L.382, No.164), entitled "An 2 act providing for the incorporation as bodies corporate and 3 politic of "Authorities" for municipalities, counties and 4 townships; prescribing the rights, powers and duties of such 5 Authorities heretofore or hereafter incorporated; authorizing 6 such Authorities to acquire, construct, improve, maintain and 7 operate projects, and to borrow money and issue bonds 8 therefor; providing for the payment of such bonds, and 9 prescribing the rights of the holders thereof; conferring the 10 right of eminent domain on such Authorities; authorizing such 11 Authorities to enter into contracts with and to accept grants 12 from the Federal Government or any agency thereof; and 13 conferring exclusive jurisdiction on certain courts over 14 rates," providing for approval for the sale of an authority. 15 The General Assembly of the Commonwealth of Pennsylvania 16 hereby enacts as follows: 17 Section 1. The act of May 2, 1945 (P.L.382, No.164), known 18 as the Municipality Authorities Act of 1945, is amended by 19 adding a section to read: 20 Section 14.1. Approval for the Sale of Authority.--A. Prior 21 to the termination of any Authority and the conveyance of 22 Authority property to a private entity, the Authority shall 23 submit information regarding the proposed plan for review and
1 comment to the governing bodies of all municipalities served by 2 the Authority for ratification. The Authority shall also make 3 information regarding the proposed plan available for public 4 review and comment. The period for review and comment shall be 5 thirty (30) days. 6 B. The Authority may not conclude the sale of the Authority 7 property within thirty (30) days from the end of the public 8 comment period. If a municipality does not act on the proposed 9 sale within forty-five (45) days of its submission to such 10 municipality, it shall be deemed to have ratified the proposed 11 sale. If more than one-quarter of the municipalities, 12 representing more than one-quarter of the population of the 13 Authority's service area, as determined by the most recent 14 decennial census by the United States Bureau of the Census, 15 object to the proposed sale, then proposed sale shall be 16 disallowed. 17 Section 2.
