AN ACT 1 Prohibiting the use of Social Security numbers to identify 2 individuals; and providing for a penalty. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the Social 7 Security Number Identity Protection Act. 8 Section 2. Definitions. 9 The following words and phrases when used in this act shall 10 have the meanings given to them in this section unless the 11 context clearly indicates otherwise: 12 "Person." An individual, including a private entity and a 13 public entity. 14 "Private entity." Any of the following entities located or 15 doing business in this Commonwealth:
1 (1) An individual. 2 (2) A corporation. 3 (3) A trust. 4 (4) An unincorporated association. 5 (5) A not-for-profit organization. 6 (6) A partnership. 7 (7) An affiliate. 8 (8) Any other commercial entity not listed in paragraphs 9 (1) through (7). 10 "Public entity." An officer, employee or agent of an agency, 11 department, board, commission or political subdivision of the 12 Commonwealth, acting within the scope of that person's official 13 duties, employment or agency. 14 "Publicly posting or displaying." To intentionally 15 communicate or otherwise make available to the general public. 16 Section 3. Use of Social Security numbers. 17 No person shall use an individual's Social Security number in 18 any manner for identification purposes, including any of the 19 following: 20 (1) Publicly posting or displaying the number in any 21 manner. 22 (2) Printing the number on any card required for the 23 individual to access products or services provided by the 24 entity. 25 (3) Requiring an individual to use or transmit the 26 number to access an Internet website. 27 (4) Printing the number on any materials that are mailed 28 to the individual unless Federal or State law requires the 29 number to be on the document to be mailed. 30 Section 4. 1 This act shall not prevent the collection, use or release of 2 an individual's Social Security number as required by Federal or 3 State law or the use of an individual's Social Security number 4 for internal verification or administrative purposes. 5 Section 5. Violations. 6 A violation of this act shall be deemed to be a violation of 7 the act of December 17, 1968 (P.L.1224, No.387), known as the 8 Unfair Trade Practices and Consumer Protection Law. 9 Section 20.
