                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
     2     "An act relating to roads, streets, highways and bridges;
     3     amending, revising, consolidating and changing the laws
     4     administered by the Secretary of Highways and by the
     5     Department of Highways relating thereto," further providing
     6     for signs on State highways; and making editorial changes.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The title and sections 102(3) and (4) and 425 of
    10  the act of June 1, 1945 (P.L.1242, No.428), known as the State
    11  Highway Law, are amended to read:
    12                               AN ACT
    13  Relating to roads, streets, highways and bridges; amending,
    14     revising, consolidating and changing the laws administered by
    15     the Secretary of [Highways] Transportation and by the
    16     Department of [Highways] Transportation relating thereto.

    17     Section 102.  Definitions.--When used in this act, the


     1  following words and phrases shall have the following meanings:
     2     * * *
     3     (3)  "Department" shall mean the Department of [Highways]
     4  Transportation of the Commonwealth.
     5     (4)  "Secretary" shall mean the Secretary of [Highways]
     6  Transportation of the Commonwealth.
     7     Section 425.  Signs, Banners, etc., across or within Legal
     8  Limits of Highway; Penalty; Abatement.--It shall be unlawful to
     9  place any sign, banner, or advertising matter of any kind
    10  whatsoever, except for a sign indicating the time and place for
    11  a meeting of a service club, on or across any State highway or
    12  on or across any structure within the legal limits of any State
    13  highway without first having obtained the written consent of the
    14  department. The placement of a sign indicating the time and
    15  place for a meeting of a service club is subject to regulation
    16  by the department as to safe placement. Any person violating the
    17  provisions of this section shall, upon summary conviction, be
    18  sentenced to pay a fine of not less than four dollars ($4.00)
    19  nor more than twenty dollars ($20.00). All such fines shall be
    20  paid into the county treasury to be used only for the
    21  construction or repair of public roads or highways.
    22     Any such sign, banner, or advertising matter placed without
    23  the consent of the department is hereby declared to be a public
    24  nuisance, and may be abated by the department with or without
    25  notice to the persons responsible for the placing thereof.
    26     Section 2.  The Department of Transportation may promulgate
    27  regulations as to safe placement on State highways of signs
    28  indicating times and places of service club meetings.
    29     Section 3.  This act shall take effect as follows:
    30         (1)  The amendment of section 425 of the act shall take

     1     effect in 180 days.
     2         (2)  The remainder of this act shall take effect
     3     immediately.
