HOUSE BILL

        INTRODUCED BY BATTISTO, KUKOVICH, BARLEY, MORRIS, DALEY, MELIO,
           VEON, CORRIGAN, FOX, McHALE, HECKLER, TIGUE, BILLOW, WOZNIAK,
           BELARDI, BROUJOS, STABACK, BELFANTI AND FARGO, JUNE 29, 1989

                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further defining "police force."

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 650 of the act of June 24, 1931
     8  (P.L.1206, No.331), known as The First Class Township Code,
     9  reenacted and amended May 27, 1949 (P.L.1955, No.569), is
    10  amended to read:
    11     Section 650.  Police Force and Fire Apparatus Operators
    12  Defined.--Police force as used in this subdivision shall mean a
    13  police force organized and operating as prescribed by law, the
    14  members of which devote their normal working hours to police
    15  duty or duty in connection with the bureau, agencies and
    16  services connected with police protection work and who are paid
    17  a stated salary or compensation for such work by the township.
    18  Nothing in this subdivision shall prohibit a township from


     1  employing members of a police force on a regular part-time basis
     2  not subject to the civil service provisions of this subdivision,
     3  providing the regular part-time officers are duly employed
     4  municipal police officers within the meaning of 42 Pa.C.S. Ch.
     5  89 Subch. D (relating to commencement of proceedings).
     6     Fire apparatus operators as used in this subdivision shall
     7  mean any person who operates fire apparatus and devotes his
     8  normal working hours to operating any piece of fire apparatus or
     9  other services connected with fire protection work and who is
    10  paid a stated salary or compensation for such work done by the
    11  township.
    12     Section 2.  This act shall take effect in 60 days.
