                                     AN ACT

     1  Amending the act of July 22, 1974 (P.L.589, No.205), entitled
     2     "An act relating to unfair insurance practices; prohibiting
     3     unfair methods of competition and unfair or deceptive acts
     4     and practices; and prescribing remedies and penalties,"
     5     further defining "renewal" or "to renew."

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The definition of "renewal" or "to renew" in
     9  section 3 of the act of July 22, 1974 (P.L.589, No.205), known
    10  as the Unfair Insurance Practices Act, is amended to read:
    11     Section 3.  Definitions.--As used in this act:
    12     * * *
    13     "Renewal" or "to renew" means the issuance and delivery by an
    14  insurer [of a policy superseding] at the end of the policy
    15  period:
    16         (1)  a policy which supersedes a policy previously issued
    17     and delivered by the same insurer[, such renewal policy to
    18     provide types and limits of coverage at least equal to those
    19     contained in the policy being superseded, or the issuance and

     1     delivery of]; or
     2         (2)  a certificate or notice extending the term of a
     3     policy beyond its policy period or term [with];
     4  either of which has equal types and limits of coverage [at least
     5  equal to those contained] in the policy being [extended:]
     6  superseded or extended or which has different types and limits
     7  of coverage in the policy being superseded or extended so long
     8  as the commissioner has approved such policy and any
     9  endorsements and the insurer discloses such policy differences
    10  to the insured no less than thirty days prior to the effective
    11  date of the renewal: Provided, however, That any policy with a
    12  policy period or term of less than twelve months or any period
    13  with no fixed expiration date shall for the purpose of this
    14  [act] article be considered as if written for successive policy
    15  periods or terms of twelve months.
