                                     AN ACT

     1  Relating to release of reports pertaining to inspection of
     2     personal care homes.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Personal Care
     7  Home Inspection Report Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Public Welfare of the
    13  Commonwealth.
    14     "Personal care home."  As defined in section 1001 of the act
    15  of June 13, 1967 (P.L.31, No.21), known as the Public Welfare


     1  Code.
     2  Section 3.  Inspection report.
     3     Upon inspection of a personal care home which is required to
     4  be approved and inspected by the department pursuant to Articles
     5  IX and X of the act of June 13, 1967 (P.L.31, No.21), known as
     6  the Public Welfare Code, the department shall prepare a report
     7  that indicates, at a minimum, all of the following information:
     8         (1)  The date of inspection.
     9         (2)  The degree to which the facility complies with law
    10     and regulations.
    11         (3)  Any violation of law or regulation, with specific
    12     citation of statute or regulation.
    13         (4)  A plan of correction to correct any deficiency or
    14     violation within a period of time specified by the
    15     department.
    16         (5)  A determination by the department as to whether it
    17     will issue a certificate of compliance, and if so, whether it
    18     is a full or provisional certificate; if a certificate will
    19     be revoked; or whether any other action is taken by the
    20     department, including relocation of any resident.
    21  Section 4.  Release of report to public.
    22     Upon completion of an inspection report, the department shall
    23  release the report to any individual who requests a copy of the
    24  report. The department shall send a copy of an inspection report
    25  to a requester as soon as possible, but no later than seven
    26  business days following a request. A request pursuant to this
    27  section need not be made in writing.
    28  Section 5.  Posting of inspection report.
    29     A copy of the most recent inspection report of a personal
    30  care home and its current certificate of compliance shall be

     1  posted in a conspicuous place in the personal care home.
     2  Section 6.  Effective date.
     3     This act shall take effect immediately.
