                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further authorizing political
     3     subdivisions to impose additional requirements on the
     4     ownership, possession, transfer or transportation of
     5     firearms.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 6120 of Title 18 of the Pennsylvania
     9  Consolidated Statutes is amended to read:
    10  § 6120.  Limitation on municipal regulation of firearms and
    11             ammunition.
    12     (a)  General rule.--[No county, municipality or township may
    13  in any manner regulate the lawful ownership, possession,
    14  transfer or transportation of firearms, ammunition or ammunition
    15  components when carried or transported for purposes not
    16  prohibited by the laws of this Commonwealth.] In addition to the
    17  provisions of this title, a county, municipality or township may
    18  impose additional requirements or restrictions upon the
    19  ownership, possession, transfer or transportation of firearms,

     1  ammunition or ammunition components within its jurisdiction.
     2     [(a.1)  No right of action.--
     3         (1)  No political subdivision may bring or maintain an
     4     action at law or in equity against any firearms or ammunition
     5     manufacturer, trade association or dealer for damages,
     6     abatement, injunctive relief or any other relief or remedy
     7     resulting from or relating to either the lawful design or
     8     manufacture of firearms or ammunition or the lawful marketing
     9     or sale of firearms or ammunition to the public.
    10         (2)  Nothing in this subsection shall be construed to
    11     prohibit a political subdivision from bringing or maintaining
    12     an action against a firearms or ammunition manufacturer or
    13     dealer for breach of contract or warranty as to firearms or
    14     ammunition purchased by the political subdivision.]
    15     (b)  [Definitions.--As used in this section, the following
    16  words and phrases shall have the meanings given to them in this
    17  subsection:
    18     "Dealer."  The term shall include any person engaged in the
    19  business of selling at wholesale or retail a firearm or
    20  ammunition.
    21     "Firearms."  This term] Definition.--As used in this section,
    22  the term "firearms" shall have the meaning given to it in
    23  section 5515 (relating to prohibiting of paramilitary training)
    24  but shall not include air rifles as that term is defined in
    25  section 6304 (relating to sale and use of air rifles).
    26     ["Political subdivision."  The term shall include any home
    27  rule charter municipality, county, city, borough, incorporated
    28  town, township or school district.]
    29     Section 2.  This act shall take effect in 60 days.
