        INTRODUCED BY HANNA, DALEY, COY, CORRIGAN, McCALL, WOJNAROSKI,
           TRELLO, YOUNGBLOOD, BAKER, TRAVAGLIO, GRUCELA, BENNINGHOFF,
           RAMOS, M. COHEN, MELIO, STEELMAN AND HARHAI,
           SEPTEMBER 27, 1999

                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," further providing for
    21     campus police powers and duties.

    22     The General Assembly of the Commonwealth of Pennsylvania
    23  hereby enacts as follows:
    24     Section 1.  Section 2416.1 of the act of April 9, 1929
    25  (P.L.177, No.175), known as The Administrative Code of 1929,
    26  added November 26, 1997 (P.L.530, No.57), is amended to read:


     1     Section 2416.1.  Campus Police Powers and Duties.--(a)
     2  Campus Police shall have the power and their duty shall be:
     3     (1)  to enforce good order on the grounds and in the
     4  buildings of the college or university;
     5     (2)  to protect the grounds and buildings of the college or
     6  university;
     7     (3)  to exclude all disorderly persons from the grounds and
     8  buildings of the college or university;
     9     (4)  to adopt whatever means may be necessary for the
    10  performance of their duties;
    11     (5)  to exercise the same powers as are now or may hereafter
    12  be exercised under authority of law or ordinance by the police
    13  of the municipalities wherein the college or university is
    14  located, including, but not limited to, those powers conferred
    15  pursuant to 42 Pa.C.S. Ch. 89 Subch. D (relating to municipal
    16  police jurisdiction);
    17     (6)  to prevent crime, investigate criminal acts, apprehend,
    18  arrest and charge criminal offenders and issue summary citations
    19  for acts committed on the grounds and in the buildings of the
    20  college or university and carry the offender before the proper
    21  alderman, justice of the peace, magistrate or bail commissioner
    22  and prefer charges against him under the laws of this
    23  Commonwealth. Except when acting pursuant to 42 Pa.C.S. Ch. 89
    24  Subch. D, Campus Police shall exercise these powers and perform
    25  these duties only on the grounds or within 500 yards of the
    26  grounds of the college or university. For the purposes of
    27  applying the provisions of 42 Pa.C.S. Ch. 89 Subch. D, the
    28  grounds and within 500 yards of the grounds of the college or
    29  university shall constitute the primary jurisdiction of the
    30  Campus Police;

     1     (7)  to order off the grounds and out of the buildings of the
     2  college or university all vagrants, loafers, trespassers and
     3  persons under the influence of liquor and, if necessary, remove
     4  them by force and, in case of resistance, carry such offenders
     5  before an alderman, justice of the peace, bail commissioner or
     6  magistrate; and
     7     (8)  to arrest any person who damages, mutilates or destroys
     8  the trees, plants, shrubbery, turf, grass plots, benches,
     9  buildings and structures or commits any other offense on the
    10  grounds and in the buildings of the college or university and
    11  carry the offender before the proper alderman, justice of the
    12  peace, bail commissioner or magistrate and prefer charges
    13  against him under the laws of this Commonwealth.
    14     (b)  Campus Police and municipalities are authorized to enter
    15  into an agreement with the municipality wherein the college or
    16  university is located to exercise concurrently those powers and
    17  to perform those duties conferred pursuant to a cooperative
    18  police service agreement in accordance with 42 Pa.C.S. § 8953
    19  (relating to Statewide municipal police jurisdiction). When so
    20  acting, the Campus Police of the college or university shall
    21  have the same powers, immunities and benefits granted to police
    22  officers in 42 Pa.C.S. Ch. 89 Subch. D.
    23     (c)  When acting within the scope of the authority of this
    24  section, Campus Police are at all times employes of the college
    25  or university and shall be entitled to all of the rights and
    26  benefits accruing therefrom.
    27     (d)  As used in this section:
    28     "Campus Police" means all law enforcement personnel employed
    29  by a State-owned, State-aided or State-related college or
    30  university who have successfully completed a Campus Police

     1  course of training approved under 53 Pa.C.S. Ch. 21 Subch. D
     2  (relating to municipal police education and training).
     3     "College" or "university" means all State-owned, State-aided
     4  or State-related colleges and universities.
     5     "Grounds" means all lands and buildings owned, controlled,
     6  leased or managed by a college or university.
     7     Section 2.  This act shall take effect in 60 days.
