                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, defining "trail bikes"; and permitting limited
     3     highway crossings and use.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The definition of "all-terrain vehicle" in
     7  section 7702 of Title 75 of the Pennsylvania Consolidated
     8  Statutes is amended to read:
     9  § 7702.  Definitions.
    10     The following words and phrases when used in this chapter
    11  shall have, unless the context clearly indicates otherwise, the
    12  meanings given to them in this section:
    13     * * *
    14     "Trail bike."  A motorized off-highway vehicle, 60 inches or
    15  less in width, having a dry weight of 800 pounds or less,
    16  traveling on two tires and having a seat designed to be
    17  straddled by the operator is designated as a Class III all-
    18  terrain vehicle.

     1     Section 2.  Section 7721(c) and 7723 of Title 75 are amended
     2  to read:
     3  § 7721.  Operation on streets and highways.
     4     * * *
     5     (c)  Crossing street or highway.--A snowmobile or trail bike
     6  or an ATV may make a direct crossing of a street or highway upon
     7  compliance with the following requirements:
     8         (1)  The crossing is made at an angle of approximately 90
     9     degrees to the direction of the highway and at a place where
    10     no obstruction prevents a quick and safe crossing.
    11         (2)  The snowmobile, trail bike or ATV is brought to a
    12     complete stop before crossing the shoulder or main-traveled
    13     way of the highway.
    14         (3)  The driver yields the right-of-way to all oncoming
    15     traffic which constitutes an immediate hazard.
    16         (4)  In crossing a divided highway, the crossing is made
    17     only at an intersection of such highway with another public
    18     street or highway.
    19  § 7723.  Special snowmobile, trail bike and ATV events.
    20     (a)  General rule.--Snowmobiles, trail bikes and ATV's may be
    21  operated on highways and streets for special snowmobile, trail
    22  bike and ATV events of limited duration which are conducted
    23  according to a prearranged schedule under permit from the
    24  governmental agency having jurisdiction.
    25     (b)  Authority of local authorities.--A local authority may
    26  block off highways and streets within its jurisdiction for the
    27  purpose of allowing snowmobile, trail bike and ATV races,
    28  rallies or derbies. No State trunk highway or connecting street,
    29  or part thereof, shall be blocked off by any local authority for
    30  any snowmobile, trail bike or ATV race, rally or derby.

     1     (c)  Notification and duty of police.--A local authority
     2  shall notify the local police department and the county
     3  sheriff's office at least one week in advance of the time and
     4  place of any snowmobile, trail bike or ATV race, rally or derby
     5  which may result in any highway or street, or part thereof,
     6  being blocked off. Upon such notice, the local police department
     7  shall take such measures as it deems appropriate to protect
     8  persons and property and to regulate traffic in the designated
     9  area and its vicinity on the day of such race, rally or derby.
    10     Section 3.  This act shall take effect in 60 days.
