HOUSE BILL

           McGEEHAN, JAMES AND ROBERTS, OCTOBER 7, 1997

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," further providing for qualifications of electors
    12     at primaries.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Section 702 of the act of June 3, 1937 (P.L.1333,
    16  No.320), known as the Pennsylvania Election Code, is amended to
    17  read:
    18     Section 702.  Qualifications of Electors at Primaries.--The
    19  qualifications of electors entitled to vote at primaries shall
    20  be the same as the qualifications of electors entitled to vote
    21  at elections within the election district where the primary is
    22  held, provided that [no]:


     1     (1)  No elector who is not registered and enrolled as a
     2  member of a political party, in accordance with the provisions
     3  of this act, shall be permitted to vote the ballot of such party
     4  or any other party ballot at any primary.
     5     (2)  An elector who is not eighteen years of age on a primary
     6  election, but who will be eighteen years of age or older on the
     7  general or special election immediately following such primary
     8  election, shall be entitled to vote at the primary election if
     9  the elector is otherwise qualified to vote in the primary
    10  election.
    11     Section 2.  This act shall take effect in 60 days.
