AN ACT

 

1Amending Title 35 (Health and Safety) of the Pennsylvania
2Consolidated Statutes, providing for certified fire
3protection specialist misrepresentation.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Chapter 73 of Title 35 of the Pennsylvania
7Consolidated Statutes is amended by adding a subchapter to read:

14This subchapter relates to certified fire protection
15specialist misrepresentation.

16§ 7342. Fire protection specialist certification.

17(a) Misrepresentation.--An individual who is not duly
18certified as a fire protection specialist by the National Fire

1Protection Association may not hold himself out as a certified
2fire protection specialist with the intent to deceive another
3person.

4(b) Certification list.--To the greatest extent possible,
5the Office of the State Fire Commissioner shall obtain and
6maintain a current list of certified fire protection specialists
7as provided by the National Fire Protection Association.

8(c) Penalties.--An individual who violates subsection (a)
9commits a summary offense and shall, upon conviction, be
10sentenced as follows:

11(1) For a first offense, to pay a fine of not more than
12$250.

13(2) For a second or subsequent offense, to pay a fine of
14not more than $1,000 or imprisonment for not more than six
15months, or both.

16Section 2. This act shall take effect in 30 days.
