AN ACT
1 Authorizing the incurring of indebtedness, with the approval of
2 the electors, of $150,000,000 to provide additional funding
3 for the preservation AND CLEANUP of land for open space uses, <--
4 including the mitigation of flood hazards.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Referendum.
8 The question of incurring indebtedness of $150,000,000 to
9 provide additional funding for the preservation AND CLEANUP of <--
10 land for open space uses, including the mitigation of flood
11 hazards shall be submitted to the electors at the next primary,
12 municipal or general election following the effective date of
13 this act.
14 Section 2. Certification.
15 The Secretary of the Commonwealth shall forthwith certify the
16 question to the county boards of election.
17 Section 3. Form of question.
1 The question shall be in substantially the following form:
2 Do you favor the incurring of indebtedness by the
3 Commonwealth of $150,000,000 to provide funding for the
4 preservation AND CLEANUP of land for open space uses, <--
5 including the mitigation of flood hazards?
6 Section 4. Conduct of referendum.
7 The election shall be conducted in accordance with the act of
8 June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
9 Election Code, except that the time limits for advertisement of
10 notice of the election may be waived as to the question.
11 Section 5. Use of bond proceeds.
12 Proceeds of borrowing shall be used to provide funding to
13 preservation AND CLEANUP of land for open space uses, including <--
14 the mitigation of flood hazards to promote the purposes of the
15 act of January 19, 1968 (1967 P.L.992, No.442), entitled, as
16 amended, "An act authorizing the Commonwealth of Pennsylvania
17 and the local government units thereof to preserve, acquire or
18 hold land for open space uses."
19 Section 6. Effective date.
20 This act shall take effect immediately.
