AN ACT 1 Amending Title 13 (Commercial Code) of the Pennsylvania 2 Consolidated Statutes, further providing for information from 3 filing office. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 9523(c) and (f) of Title 13 of the 7 Pennsylvania Consolidated Statutes are amended and the section 8 is amended by adding a subsection to read: 9 § 9523. Information from filing office; sale or license of 10 records. 11 * * * 12 (c) Communication of requested information.--The filing 13 office shall communicate or otherwise make available in a record 14 the following information to any person that requests it: 15 (1) Whether there is on file on a date and time
1 specified by the filing office, but not a date earlier than 2 three business days before the filing office receives the 3 request, any financing statement which: 4 (i) designates a particular debtor or, if the 5 request so states, designates a particular debtor at the 6 address specified in the request; 7 (ii) has not lapsed under section 9515 (relating to 8 duration and effectiveness of financing statement; effect 9 of lapsed financing statement) with respect to all 10 secured parties of record; and 11 (iii) if the request so states, has lapsed under 12 section 9515 and a record of which is maintained by the 13 filing office under section 9522(a) (relating to post- 14 lapse maintenance and retrieval of information). 15 (2) The date and time of filing of each financing 16 statement. 17 (3) The information provided in each financing 18 statement[.], except for Social Security numbers appearing on 19 the financing statement. 20 (c.1) Duty to make Social Security numbers illegible.--The 21 filing office shall render illegible any Social Security numbers 22 appearing on any financing statement before making the financial 23 statement available to any person. Failure of the filing office 24 to do so shall entitle the person whose Social Security number 25 was disclosed to receive a civil penalty of $100 from the filing 26 office for each person to whom the Social Security number was 27 disclosed. 28 * * * 29 (f) Public availability of records.--[At least weekly, the] 30 The filing office described in section 9501(a)(2) shall not 20050H1918B2623 - 2 -
1 offer to sell or license to the public [on a nonexclusive
2 basis], in bulk, copies of all records filed in it under this
3 chapter in [every] any medium [from time to time available to
4 the filing office].
5 Section 2. This act shall take effect in 60 days.
