                                     AN ACT

     1  Amending Title 13 (Commercial Code) of the Pennsylvania
     2     Consolidated Statutes, further providing for information from
     3     filing office.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 9523(c) and (f) of Title 13 of the         <--
     7  Pennsylvania Consolidated Statutes are amended and the section
     8  is amended by adding a subsection to read:
     9     SECTION 1.  SECTION 9523(C) OF TITLE 13 OF THE PENNSYLVANIA    <--
    10  CONSOLIDATED STATUTES IS AMENDED AND THE SECTION IS AMENDED BY
    11  ADDING A SUBSECTION TO READ:
    12  § 9523.  Information from filing office; sale or license of
    13             records.

     1     (c)  Communication of requested information.--The filing
     2  office shall communicate or otherwise make available in a record
     3  the following information to any person that requests it:
     4         (1)  Whether there is on file on a date and time
     5     specified by the filing office, but not a date earlier than
     6     three business days before the filing office receives the
     7     request, any financing statement which:
     8             (i)  designates a particular debtor or, if the
     9         request so states, designates a particular debtor at the
    10         address specified in the request;
    11             (ii)  has not lapsed under section 9515 (relating to
    12         duration and effectiveness of financing statement; effect
    13         of lapsed financing statement) with respect to all
    14         secured parties of record; and
    15             (iii)  if the request so states, has lapsed under
    16         section 9515 and a record of which is maintained by the
    17         filing office under section 9522(a) (relating to post-
    18         lapse maintenance and retrieval of information).
    19         (2)  The date and time of filing of each financing
    20     statement.
    21         (3)  The information provided in each financing
    22     statement[.], except for Social Security numbers appearing on
    23     the financing statement.
    24     (c.1)  Duty to make Social Security numbers illegible.--The
    25  filing office shall render illegible any Social Security numbers
    26  appearing on any financing statement before making the financial
    27  statement available to any person. Failure of the filing office
    28  to do so shall entitle the person whose Social Security number
    29  was disclosed to receive a civil penalty of $100 from the filing
    30  office for each person to whom the Social Security number was

     3     (f)  Public availability of records.--[At least weekly, the]   <--
     4  The filing office described in section 9501(a)(2) shall not
     5  offer to sell or license to the public [on a nonexclusive
     6  basis], in bulk, copies of all records filed in it under this
     7  chapter in [every] any medium [from time to time available to
     8  the filing office].
     9     Section 2.  This act shall take effect in 60 days.
