                                     AN ACT

     1  Requiring that in public buildings the number of restroom
     2     facilities available to women exceeds the number of restroom
     3     facilities available to men.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Restroom
     8  Facilities Act.
     9  Section 2.  Declaration of purpose.
    10     The purpose of this act is to end the inequitable delays that
    11  women face when they need to use restroom facilities in public
    12  buildings, while men are rarely required to wait to use restroom
    13  facilities.
    14  Section 3.  Definitions.
    15     The following words and phrases when used in this act shall
    16  have the meanings given to them in this section unless the

     1  context clearly indicates otherwise:
     2     "Department."  The Department of Labor and Industry of the
     3  Commonwealth.
     4     "Public building."  A building owned or leased by the
     5  Commonwealth, an agency or instrumentality of the Commonwealth
     6  or a political subdivision.
     7  Section 4.  Restroom requirement.
     8     In all public buildings, the number of restroom facilities
     9  designed for and available to women shall be greater than the
    10  number of restroom facilities designed for and available to men.
    11  Section 5.  Rules and regulations.
    12     The department shall promulgate rules and regulations to
    13  administer and enforce this act.
    14  Section 6.  Applicability.
    15     This act shall apply to public buildings that are constructed
    16  or leased on and after January 1, 1990.
    17  Section 7.  Effective date.
    18     This act shall take effect immediately.
