        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, FEBRUARY 10, 2004

                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, providing for the penalty for a felony violation of
     3     the second degree.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 905 and 925(b) of Title 34 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 905.  Assaulting an officer.
     9     A person who INTENTIONALLY, KNOWINGLY OR RECKLESSLY attempts   <--
    10  to cause or causes bodily injury SERIOUS BODILY [INJURY] HARM to  <--
    11  an officer [making an arrest or investigation for a violation of  <--
    12  this title or] performing any duties required by this title       <--
    13  commits a [misdemeanor] felony of the second degree.


     1  § 925.  Jurisdiction and penalties.
     2     * * *
     3     (b)  Fines and penalties for violations.--In addition to any
     4  other requirements of this title, the following fines and
     5  penalties shall be imposed for violations of this title:
     6         (1)  Felony of the second degree, not less than $5,000
     7     nor more than $25,000 and, OR may be sentenced to              <--
     8     imprisonment up to ten years, OR BOTH.                         <--
     9         [(1)]  (1.1)  Misdemeanor of the first degree, not less
    10     than $2,000 nor more than $10,000 and may be sentenced to
    11     imprisonment up to six months.
    12         (2)  Misdemeanor of the second degree, not less than
    13     $1,000 nor more than $5,000 and may be sentenced to
    14     imprisonment up to six months.
    15         (3)  Misdemeanor of the third degree, not less than $500
    16     nor more than $2,500 and may be sentenced to imprisonment up
    17     to six months.
    18         (4)  Summary offense of the first degree, $800.
    19         (5)  Summary offense of the second degree, $500.
    20         (6)  Summary offense of the third degree, $300.
    21         (7)  Summary offense of the fourth degree, $200.
    22         (8)  Summary offense of the fifth degree, $100.
    23         (9)  Summary offense of the sixth degree, $75.
    24         (10)  Summary offense of the seventh degree, $50.
    25         (11)  Summary offense of the eighth degree, $25.
    26  In addition to the imposition of any fines, costs of prosecution
    27  shall also be assessed pursuant to 42 Pa.C.S. §§ 1725.1
    28  (relating to costs) and 3571 (relating to Commonwealth portion
    29  of fines, etc.).
