                                     AN ACT

     1  Amending Title 23 (Domestic Relations) of the Pennsylvania
     2     Consolidated Statutes, providing for unlawful transfer of
     3     weapons.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 23 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6119.  Unlawful transfer of weapons.
     9     (a)  Offense defined.--It shall be unlawful for a defendant
    10  to transfer weapons to another to avoid turning them over to a
    11  police officer or sheriff as specified in section 6108(a)(7)
    12  (relating to relief) or 6113 (relating to arrest for violation
    13  of order).
    14     (b)  Acceptance of weapons.--It shall be unlawful for a
    15  person to knowingly, intentionally or recklessly accept and
    16  retain possession of weapons from a defendant who has been

     1  ordered by a court to relinquish such weapons pursuant to
     2  section 6108(a)(7) or from a defendant who has been arrested for
     3  violation of an order pursuant to section 6113. It shall be an
     4  affirmative defense to a violation of this subsection if the
     5  person accepted possession and then immediately notified the
     6  police of the acceptance of possession of the defendant's
     7  weapons.
     8     (c)  Penalty.--A person who violates subsection (a) commits a
     9  misdemeanor of the second degree. A person who violates
    10  subsection (b) commits a misdemeanor of the third degree.
    11     Section 2.  This act shall take effect immediately.
