AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for emission inspection 3 expenditures. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 4706(b) of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 4706. Prohibition on expenditures for emission inspection 9 program. 10 * * * 11 (b) Exception.--The provisions of subsection (a) shall not 12 apply when the secretary shall certify that a system is required 13 to comply with Federal law and is necessary for the Commonwealth 14 to receive or avoid the loss of Federal funds in which case the
1 department may establish and administer such a system for motor 2 vehicles registered in areas where periodic inspection of 3 emissions or emission systems of motor vehicles is required by 4 the Environmental Protection Agency of the United States or 5 decrees of the courts of the United States. The program may not 6 require vehicle emission inspections on a more frequent than 7 biennial basis. 8 * * * 9 Section 2. The provisions of 67 Pa. Code § 177.51(c) are 10 abrogated. 11 Section 3.
