AN ACT 1 Amending Title 62 (Procurement) of the Pennsylvania Consolidated 2 Statutes, providing for the procurement of hybrid electric 3 vehicles. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Sections 3732 and 3734 of Title 62 of the 7 Pennsylvania Consolidated Statutes are amended to read: 8 § 3732. Definitions. 9 The following words and phrases when used in this subchapter 10 shall have the meanings given to them in this section unless the 11 context clearly indicates otherwise: 12 "Hybrid electric vehicles." Motor vehicles in which at least 13 one of the energy sources or converters can deliver electric 14 energy to propel the vehicle. 15 "Motor vehicle." A passenger car or a truck as those terms 16 are defined under 75 Pa.C.S. § 102 (relating to definitions). 17 "Procure." To acquire by purchase, lease or rent. The term
1 does not include any rentals or leases where the term thereof is 2 less than one month. 3 § 3734. Contract provisions. 4 (a) Motor vehicles to be manufactured in North America.--All 5 government agencies shall procure only motor vehicles which are 6 manufactured in North America. A motor vehicle is manufactured 7 in North America if a substantial majority of the principal 8 components are assembled into the final product in an assembly 9 plant in North America. Contract documents for the procurement 10 of motor vehicles shall contain a provision that the vehicles 11 procured by the government agency shall be manufactured in North 12 America. 13 (a.1) Hybrid electric vehicles.--Beginning on January 1, 14 2007, at least 10% of all vehicles procured by Commonwealth 15 agencies each year shall be hybrid electric vehicles. 16 (b) Exception.--This section shall not apply where the head 17 of the government agency states in writing that it is 18 inconsistent with the public interest or that the cost is 19 unreasonable. 20 Section 2.
